Welcome to Stack's. These Terms of Service ("Terms") govern your access to and use of the Stack's platform, available at tradestacks.app (the "Service"), operated by STACK'S, a Belgian limited liability company ("Stack's", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Important: Stack's is a social platform for sharing trading plans. It is not a financial advisor, broker, or regulated financial services provider. Please read our Risk Disclaimer carefully before using the Service.


1. Definitions

  • "Service" means the Stack's platform, website, and all related features.
  • "Account" means your registered user account on the Service.
  • "Content" means any data, text, trading plan, post, comment, media, or other material you publish or submit to the Service.
  • "Trading Plan" means a structured publication containing entry price, stop-loss, take-profit, risk-reward ratio, and related fields.
  • "User" or "you" means any individual who accesses or uses the Service.

2. Eligibility and Account Registration

2.1 Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding contract in your jurisdiction
  • Not be prohibited from using the Service under applicable laws
  • Have received a valid invitation to the alpha (during the invite-only phase)

2.2 Account creation

You may create an Account using:

  • Email and password
  • Google OAuth
  • A Web3 wallet (MetaMask, WalletConnect, or similar)

You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. You must notify us immediately at legal@tradestacks.app if you suspect unauthorized access.

2.3 Alpha access

The Service is currently in closed alpha and accessible by invitation only. We reserve the right to grant, deny, suspend, or revoke alpha access at our sole discretion, with or without notice. Alpha access does not grant any permanent or ongoing right to use the Service.

2.4 Account accuracy

You agree to provide accurate information and to keep it up to date.


3. The Service

3.1 What Stack's provides

Stack's is a social platform where users publish trading plans and engage in community discussions. Core features include:

  • Publishing structured trading plans with entry, stop-loss, and take-profit levels
  • Automatic tracking of plan outcomes via market data from public APIs
  • Public and private communities
  • Leaderboard ranking based on published plan performance
  • Real-time chat and feeds within communities

3.2 What Stack's is not

Stack's is not:

  • A financial advisor, investment advisor, or portfolio manager
  • A broker, exchange, or trading venue
  • A custodian of funds or assets
  • A licensed or regulated financial services provider under Belgian or EU financial law
  • Responsible for the accuracy, quality, or outcomes of any trading plan published by users

4. User Content

4.1 Your content, your responsibility

You retain ownership of all Content you publish on the Service. You are solely responsible for your Content and its legality, accuracy, and consequences.

4.2 License to Stack's

By publishing Content on the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, modify (for formatting purposes), and distribute your Content as necessary to operate the Service and promote the platform (e.g., quoting public plans in marketing).

This license continues even after you delete your Account, for the Content that remains publicly visible under Section 4.4.

4.3 Prohibited content

You must not publish Content that:

  • Is illegal, fraudulent, or misleading
  • Constitutes financial advice offered as a regulated service without proper authorization
  • Promotes market manipulation, pump-and-dump schemes, insider trading, or other abusive practices
  • Infringes on intellectual property, privacy, or other rights of third parties
  • Contains malware, spam, or phishing attempts
  • Is hateful, harassing, defamatory, sexually explicit, or otherwise harmful
  • Impersonates another person or entity

We reserve the right to remove Content that violates these Terms, without notice.

4.4 Immutability of Trading Plans — CRITICAL

Trading plans are immutable by design. Once published, a trading plan cannot be edited or deleted. Users can only publish a new version.

This is a core architectural feature of the Service. Its purpose is to guarantee the integrity of track records and prevent retroactive manipulation. You acknowledge and accept that:

  • Your published trading plans are permanent
  • You cannot request their deletion, even via GDPR erasure rights (Art. 17 GDPR permits retention where necessary for the legitimate interest of the Service's integrity)
  • Upon account deletion, your plans and posts will be anonymized (username replaced) but remain visible

Do not publish a trading plan if you are not prepared for it to remain permanently visible.

4.5 Account deletion

You may request account deletion at any time via your account settings or by contacting legal@tradestacks.app. Upon deletion:

  • Your profile, private data, and preferences are removed within 30 days
  • Your published plans and posts are anonymized but retained (see Section 4.4)
  • Backup retention may extend up to 90 days for technical and legal reasons

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers, crawlers) without prior written permission, except for the future Stack's MCP server when released
  • Overload, flood, spam, or otherwise disrupt the Service
  • Circumvent access controls, authentication, or security measures
  • Create multiple accounts to manipulate leaderboard rankings or mislead other users
  • Resell, sublicense, or commercially exploit the Service without permission

Violation of these rules may result in immediate suspension or termination of your Account.


6. Pricing

The Service is currently free to use during the alpha phase. We reserve the right to introduce paid features (Pro tier) at any time, with advance notice for existing users. Paid features will be governed by additional terms communicated at that time.


7. Intellectual Property

7.1 Our IP

All rights, title, and interest in and to the Service (excluding User Content) — including the Stack's name, logo, design, code, and documentation — are owned by STACK'S and protected by Belgian, EU, and international intellectual property law.

7.2 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free right to use them for any purpose without compensation.


8. Third-Party Services

The Service integrates with or links to third-party services (Firebase, CoinGecko, MetaMask, WalletConnect, Google, etc.). We are not responsible for the content, policies, or practices of these third parties. Your use of them is governed by their own terms.

8.1 Third-Party DEX Links

Stack's may provide links to third-party decentralized exchanges ("DEX") as a convenience feature. Stack's does not facilitate, execute, or intermediate any transaction on your behalf. All fields pre-filled by Stack's are suggestions only — you are solely responsible for reviewing and confirming all transaction parameters before signing. Use of third-party DEX platforms is subject to their own terms, risks, and applicable laws. Stack's is not responsible for any losses incurred through third-party platforms.


9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Market data (prices, TP/SL triggers) will always be accurate or timely
  • Trading plans published by users will achieve their stated objectives
  • The Service will meet your specific requirements

You acknowledge that the Service is in alpha and may contain bugs, incomplete features, and unexpected behavior.


10. Limitation of Liability

To the maximum extent permitted by Belgian and EU law, STACK'S shall not be liable for:

  • Any trading losses, financial losses, or missed opportunities resulting from your use of the Service
  • Decisions you make based on Content published by other users
  • Inaccurate, delayed, or missing market data
  • Service interruptions or downtime
  • Indirect, incidental, consequential, special, or punitive damages

Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed one hundred euros (€100) or the amount you paid us in the twelve (12) months preceding the claim, whichever is greater.

These limitations do not apply where prohibited by Belgian consumer protection law (where applicable to you as a consumer), in cases of gross negligence, willful misconduct, or death or personal injury caused by our negligence.


11. Indemnification

You agree to indemnify and hold harmless STACK'S, its directors, employees, and affiliates from any claim, damage, liability, or cost (including reasonable legal fees) arising out of:

  • Your breach of these Terms
  • Your Content
  • Your use of the Service
  • Your violation of any law or third-party rights

12. Suspension and Termination

12.1 By you

You may stop using the Service and delete your Account at any time.

12.2 By us

We may suspend or terminate your access to the Service, with or without notice, if:

  • You breach these Terms
  • We reasonably believe you pose a security or legal risk
  • We decide to discontinue the Service or the alpha program
  • We are required to do so by law

Upon termination, Sections 4.2, 4.4, 7, 9, 10, 11, 13, and 14 survive.


13. Governing Law and Jurisdiction

These Terms are governed by the laws of Belgium, excluding conflict-of-law rules.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of {{COURT_LOCATION, e.g., Charleroi or Brussels}}, Belgium, except where mandatory consumer protection law provides otherwise.

If you are a consumer residing in the EU, you may also file a complaint via the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.


14. Miscellaneous

  • Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • No waiver: our failure to enforce any right or provision is not a waiver of that right.
  • Assignment: you may not assign these Terms without our written consent. We may assign them to an affiliate or successor.
  • Entire agreement: these Terms, together with the Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and us regarding the Service.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email and by an in-app notice at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
